Maintenance

Have you been granted unemployment benefit II by the job center? Then existing maintenance claims are automatically transferred to the Jobcenter according to § 33 SGB II.

This means:

The Jobcenter determines the claims against the person obliged to pay maintenance and, if necessary, also enforces them in court.

This is done by the employees of the maintenance department. In principle, those entitled to maintenance can then only claim maintenance themselves with the approval of the Jobcenter.

If you are already receiving maintenance payments, this must be reported when you submit your application.

The following maintenance claims exist:
  • Child support (for minors and, under certain conditions, also for adult children) (§§ 1601 ff. BGB)
  • Separation maintenance (§§ 1361 BGB)
  • Postmarital spousal maintenance (§§ 1569 ff BGB)
  • Maintenance against the father/mother in the case of non-marital children (§ 1615l BGB)
  • Maintenance claim under the Civil Partnership Act (§ 12 LPartG)
